Terms of service

1. Who you are dealing with

Designey is operated by Florin-Elis Buju, Bauernstraße 6, 2514 Traiskirchen, Austria, reachable at office@designey.ai. Using the app, in the browser or on your phone, means these terms apply between you and us. Designey is for people aged 18 and over.

2. What the service does

You give us a photo of your room; its dimensions you type in or confirm after we estimate them from the photo. From that we put together furnishing suggestions from the range of our partner retailer XXXLutz Austria (other retailers may be added), check each piece against the dimensions of your room, and can show the result in your own photo: as a complete furnishing, as a new style for the room as it is, as a replacement for a single piece of furniture, or as a short video made from a finished picture.

It is advice, not a survey. The fit check works from the dimensions you confirm and the dimensions in the retailer's catalogue: it knows nothing about your doorways, radiators, alcoves or the furniture already in the room. Measure before you buy.

Prices, availability and product details come from the retailer's feed and can be out of date. What the retailer shows at checkout is what counts.

3. Pictures and videos are illustrations

A picture or video is generated by an AI model. It shows roughly how a set could sit in your room; it is not a photograph and not a promise. Colours, proportions, materials and details can differ from the real products, only some of a suggestion's items appear in the picture, and a video can show parts of the room that were not in your photo. Judge the products by the product list and the retailer's own pages.

Rendering sends your photo to Google in the United States, which is why it happens only after you explicitly agree; a video is made from the finished picture by a further provider in the United States. The privacy policy describes both.

4. Furniture is bought at the retailer

We sell no furniture, and none of the money you spend on it passes through us. Every product links to the retailer's shop, and any purchase is a contract between you and that retailer, under their terms. Delivery, warranty, returns and complaints about an order are theirs to answer.

Product links can be partner links: if you buy through one, the retailer pays us a commission. The price does not change for you, and it does not influence which products a suggestion contains: the selection follows fit, room and style, and does not know what any item pays. Links to retailers without a partner programme earn us nothing. The app marks retailer links as such.

The one thing sold here is credits (sections 5 to 8).

5. Credits

Pictures and videos cost credits: a picture one credit, a video several, and the number is on the button before you press it. Every account gets a one-time grant of 3 free pictures; after those, credits are bought either in one-time packs, which never renew and never expire, or on a plan, which delivers a fixed number of credits at each billing until you cancel it. Nothing resets, and nothing is taken back at the end of a period.

Credits are set aside before a picture or video is attempted and given straight back if none arrives, so an attempt that fails costs you nothing. Reopening a picture or video you already have is free, as long as you keep it.

Purchased credits never expire. They are tied to your account and cannot be moved to another one, cannot be passed on or sold, and cannot be paid out in cash: they buy pictures and videos in Designey, and nothing else. Credits from the website and from the mobile app land on the same account.

If you delete your account, any credits still unspent are lost. They are not refunded. The page that asks you to confirm the deletion tells you how many you are giving up, so this is never a surprise; and if you would rather have the money back, write to support@designey.ai (section 8) before you delete rather than after.

6. Buying credits on the website: we are the seller

Credit packs and plans on the website are sold by Florin-Elis Buju, the operator named in section 1. Your purchase contract is with us, under these terms, and nobody else sells you anything here.

The payment itself is processed by Stripe Payments Europe, Limited, Ireland. The Buy button sends you to Stripe's checkout page, you give Stripe your payment details there, and we never see your card. Your card or bank statement will show DESIGNEY.

The price you see is the price you pay: nothing is added at the checkout. Any VAT that applies is already included in it, and your invoice states which rule applied to your purchase. Your receipt and your invoice come by email; the invoices are also in the billing portal reached from your account page.

Refunds and billing questions go to support@designey.ai. A plan is cancelled from the same billing portal, and cancelling ends it at the end of the period you have already paid for.

7. Buying credits in the iOS and Android app

In the app for iOS and Android you buy credits through Apple's App Store or through Google Play, at the price the store shows in your currency. The purchase is made through the store and is additionally subject to its terms; the store takes the payment, the receipt and the invoice come from it, and we deliver the credits. Refunds follow the store's rules and deadlines, which is why you request a refund for a store purchase from the store, not from us.

If the app offers a subscription, you manage and cancel it in the subscription settings of your store account; it renews until you cancel it there, and then runs to the end of the paid period. A plan from the website is still managed there. "Restore purchases" reports your store purchases to us again; credits that have already been granted are not granted twice.

8. Your right of withdrawal

Buying credits from us is a distance contract, so as a consumer you have 14 days to withdraw from it without giving a reason. The period runs from the day the contract is concluded. To withdraw, tell us so in a clear statement, by email to support@designey.ai or by post to the address in section 1. You may use the model withdrawal form at the end of this section, but you do not have to. For purchases through the App Store or Google Play, the store's withdrawal rules apply.

What the checkout asks you, and why it matters. Credits are digital content that is not on a physical medium, and they are on your account the instant the payment goes through. So before you can pay, the checkout asks you to tick a box saying two things: that you ask for delivery to start immediately, and that you understand this ends your right of withdrawal for the credits delivered. That is what § 18 Abs. 1 Z 11 FAGG requires, and it is why the right is gone once the credits are on your account.

What we do anyway. We refund a purchase made on the website within 14 days as long as no credit from it has been spent. That is our own promise on top of the law, not a restatement of it: it costs us nothing to give back what has not been used, and a shop that keeps the money for a pack somebody bought by mistake is not one we want to run. Ask at support@designey.ai.

A plan renews until it is cancelled, and each renewal is a fresh delivery of that period's credits under the same terms. The free pictures are free, so there is nothing there to withdraw from. None of this limits your statutory rights.

9. Your account and fair use

Signing in takes an email address you control, your Google account, or in the iOS app your Apple account. What you may render is set out in section 5: 3 free pictures for life, then credits. There is no monthly window and nothing resets. The suggestions and the product list stay free however many credits you have left, and failed attempts cost nothing.

Please don't:

  • upload photos of other people, or any image you don't have the right to use (an empty room is what works best anyway);
  • upload anything illegal, or content that is not a photo of a room;
  • work around the free grant with extra accounts, or automate the app.

We may suspend or remove an account that does these things. You can delete yours at any time from your account page, with no notice and no reason needed.

10. Availability and liability

Designey is an early service. We do not promise it is available, uninterrupted or error-free, and we can change or discontinue it. We are liable without limit for intent and gross negligence, for injury to life, body or health, and wherever mandatory law says so, including your rights as a consumer. Beyond that, liability for slight negligence is excluded, in particular for purchasing decisions made on the basis of a suggestion, a fit check, a picture or a video.

If a picture or video you paid for does not happen, the credits are returned; that is the remedy for an attempt that fails, and it is why it costs nothing. Your mandatory rights as a consumer are untouched by anything above, including the conformity rights that come with paid digital content.

11. Law, dispute resolution, and changes to these terms

Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this does not deprive you of the protection of mandatory law in the country you live in. For out-of-court settlement of online disputes, consumers in Austria can turn to the Internet Ombudsstelle (ombudsstelle.at), which is free of charge.

If we change these terms we update this page and its date. Continuing to use the app after that means the new version applies; if you don't agree with it, delete your account. Changes never take away credits you already have, or free pictures you have already been given.

The necessary parts keep the service running. Beyond that we would like to measure how this site is used, and to trace errors in the app; both only with your consent.
